Terms of Service
The economic activity operator Inga Briņķe, operating under the trade name "Opapants," registration No. 23018612200, address: Zilais kalns, Dobeles pag., Dobeles nov., LV-3007, hereinafter referred to as the "Online Store," provides the content available on the website and supplies goods/services in accordance with the Terms of Service outlined below.
1. General Provisions
If a consumer purchases goods/services through the website, such mutual agreement is considered a Distance Contract and is subject to the legal regulations of the Republic of Latvia governing distance contracts, including, but not limited to, the Republic of Latvia’s “Consumer Rights Protection Law,” the Cabinet of Ministers of the Republic of Latvia Regulation “Regulations on Distance Contracts,” and other applicable laws.
2. Purchasing
The prices and specifications of the products sold in the Online Store are indicated next to the products.
To place an order, add the desired products to the shopping cart. Fill in all required fields and select the most suitable delivery method. The total order cost, including delivery, will then be displayed on the screen. Complete the payment to finalize the order.
3. Payment Terms
The currency for payments on the website is Euro. Purchases can be paid for using the following payment methods provided by the payment platform makecommerce.lv, operated by Maksekeskus AS:
- Internet banking payments in Latvia: Swedbank, SEB, Citadele, and Luminor
- Visa/Mastercard payments
Note: When using the internet banking payment method, confirm the order and click the “Return to Merchant” button.
Personal data required for processing payments is transferred to the licensed payment institution Maksekeskus AS.
The contract takes effect upon successful payment to the Online Store’s bank account. If, for any reason, the order cannot be fulfilled, the Buyer will be notified, and the paid amount will be refunded as soon as possible, but no later than 14 days after the notification is received.
4. Delivery Terms
Goods are delivered only within the territory of Latvia. Purchased goods are delivered via parcel lockers or in-store pickup. All fees and taxes required to receive the shipment at the delivery destination are to be borne by the Buyer. Delivery costs are displayed before the order is confirmed. Purchased goods are delivered to the address specified by the Buyer within 2-5 business days. In exceptional cases, the Online Store reserves the right to deliver goods within up to 30 calendar days, with prior notification to the customer.
5. Right of Withdrawal
The Buyer has the right to withdraw from the purchase of the goods within 14 calendar days from the moment of receiving the goods. (Depending on the product, the Buyer may not have mandatory withdrawal rights, in which case the reason must be clearly stated and explained.) The right of withdrawal does not apply if the Buyer is a legal entity.
To exercise the 14-day right of withdrawal, the goods may only be used for their intended purpose. The consumer is responsible for maintaining the quality and safety of the goods during the withdrawal period. If the goods are used inappropriately or damaged due to negligent handling or failure to follow instructions, or if the original packaging is lost or significantly damaged, the Online Store reserves the right to reduce the refund amount in proportion to the diminished value of the goods.
To exercise the right of withdrawal, the Buyer must contact the Online Store by sending an email regarding the return of the goods to my.opapants@gmail.com within 14 days of receiving the goods. The return of goods is provided free of charge.
The Buyer is obliged to return the goods to the Seller without undue delay, but no later than 14 days after submitting the withdrawal request to the Online Store. Upon receiving the returned goods, the Online Store will promptly, but no later than within 14 days, refund all payments received from the Buyer based on the Distance Contract.
The Seller reserves the right to withhold payment until the goods or proof of their return has been received from the Buyer. If the Buyer has chosen a delivery method other than the cheapest delivery option offered by the Online Store, the Online Store is not obliged to compensate for the additional delivery costs incurred.
The Online Store is not liable for delays in fulfilling obligations, failure to fulfill obligations, or any other type of non-performance caused by circumstances or obstacles beyond the reasonable control of the Online Store.
The Online Store reserves the right to refuse to sell goods and request the return of goods from the Buyer if the price indicated in the Online Store is significantly lower than the market price due to an error.
6. Consumer Rights Regarding Non-Conforming Goods
The Online Store is liable for any non-conformity or defects in the goods sold to the Buyer that arise within 6 months from the date of delivery or that existed at the time of delivery, provided such an assumption is not contrary to the nature of the goods or defect. The Buyer must inform the Seller of any non-conformity immediately, within 2 months of discovering it, by submitting a complaint. The Buyer may submit a complaint by contacting the Online Store via email at my.opapants@gmail.com.
The Online Store is not liable for defects that arise after the goods have been delivered to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request the repair of the goods or their replacement with new goods free of charge.
If the goods cannot be repaired or replaced, the Seller will refund all payments stipulated in the Distance Contract to the Buyer. The Seller will provide a written response to the consumer’s complaint within 15 days.
7. Processing of Buyer’s Personal Data
The Online Store processes only the personal data provided by the Buyer when placing an order, such as name, surname, email address, etc.
The Online Store transfers personal data to the transport service provider(s) to ensure the delivery of goods.
If the Buyer has explicitly consented to receiving marketing communications, including newsletters, the Online Store may periodically contact the Buyer with information about services and the latest offers. For this purpose, the Online Store may process the email address provided by the Buyer when subscribing to marketing communications. The Buyer may opt out of receiving marketing communications by notifying the Online Store via email at my.opapants@gmail.com.
8. Dispute Resolution
In matters not covered by these Terms and Conditions, the Buyer and the Seller undertake to comply with the regulations in force in the Republic of Latvia.
The Parties shall resolve any disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the Parties shall resolve the dispute in a court of the Republic of Latvia in accordance with Latvian law. Disputes between the Buyer (consumer) and the Seller may also be submitted for resolution to the Consumer Rights Protection Centre or a court of the Republic of Latvia.
The Buyer also has the right to seek resolution through European Union dispute resolution bodies.
